BEWARE OF DO IT YOURSELF!

If you do your own conveyancing you are effectively taking on all the responsibility without insurance against making mistakes and this is risky. So make sure you know what you’re doing, and do your homework.


IMPORTANT

Before the conveyancer or solicitor starts the work it’s important for you to have a realistic idea of how much it will cost. Please ask us for a statement of the likely costs.

We have the latest technology and can obtain full title searches within the same day and can keep clients, real estate agents and developers informed throughout the process.

What is Conveyancing?

Conveyancing is the legal term for transferring a title (ownership) or interest in property from one party to another.

What we do and how we can we benefit you?

  • Advise you of any risks associated with you purchase eg. New roads
  • Have you already decided to sell your house? We can give you a prepared Contract of Sale for your real estate agent within 2 days (subject to availability of Certificate of Title).
  • We will handle you your conveyancing process from start to finish, we will do all the liaising with your agent and keep you up to date along the way.
  • We can settle when you can, according to your terms of settlement.
  • Ask us about arranging your finance.
  • If there is a problem with your property settlement whereas an issue arrises and requires superior advice on a certain area of law, we have expert solicitors specialising in those areas.

The Conveyancing Process

The conveyancing process can involve a wide range of the following steps:

  • Assisting you to select an agent
  • arranging building and pest inspections
  • examining an owners corporation certificate where there is common property
  • arranging finance if required
  • perusing and exchanging the contract of sale
  • paying the deposit
  • arranging payment of stamp duties
  • preparing and perusing the mortgage agreement
  • checking if there are outstanding arrears or land tax obligations
  • researching if any government authority has a vested interest in the land or if any planned development could effect the property (eg. local council, Melbourne Water, Roads and Traffic Authority)
  • finding out any information that may not have been previously disclosed such as a fence dispute or illegal building work
  • calculating adjustments for council and water rates for the property settlement
  • overseeing the change of title with the Land and Property Information NSW
  • completing any final checks prior to settlement
  • attending settlement.

Costs

In addition to our legal professional fee you will usually be charged for ‘disbursements’(out of pocket expenses incurred on your behalf).

These can include:

  • a title search
  • certificate fees charged by authorities with responsibility for water, electricity, roads, schools etc.
  • photocopying
  • registering the mortgage.
  • building and pest inspections
  • survey report
  • establishment of mortgage
  • home building insurance
  • valuation fees
  • mortgage insurance
  • stamp duty and mortgage duty
  • council and water rates.
